ESPACIO CLARO, S.A. DE C.V. (“Responsible”), with address at Avenida Hidalgo 1995, Col. Ladrón de Guevara, C.P. 44600, in Guadalajara, Jalisco. It is committed to the protection of your personal data, assuming responsibility for its use, management, storage and confidentiality in accordance with the Federal Law on the Protection of Personal Data Held by Individuals (“LFPDPPP”) and in order to provide you with information regarding the main characteristics of the processing to which your personal data will be submitted, issue this Privacy Notice.

  • Personal data that will be required.

The personal data that is obtained verbally, in writing, or through electronic means, in accordance with the purposes for which you grant your consent, will be the following:

  • Identification data
  • Patrimonial/financial data.
  • Purposes of the processing of personal data.

The personal data obtained will be used for the following purposes:

  • Verify your identity and information.
  • Integrate your file.
  • Update your information in our database.
  • Manage payments and collections derived from the provision of the service.
  • Provide the requested services and carry out the sale of products or services requested by you (including physical, telephone and internet sales services).
  • Contact you by any means, regarding the purchase of your service or product.
  • Issuance of invoices.
  • Payment or scheduling of services.
  • Video surveillance within our facilities for your safety and that of the personnel who are there.
  • Comply with applicable regulations and requirements of authorities based on the Law for compliance with legal provisions and requirements of various authorities.
  • Retain your information to comply with legal provisions and requirements of various authorities and/or regulatory entities.
  • Compliance with customer knowledge provisions and prevention of money laundering.
  • Address your questions, complaints, complaints and suggestions.
  • Provide you with personal attention through electronic means.
  • Keep a record of your purchases and use of our services.
  • Verify and confirm your patrimonial/financial data, through the company OPENPAY, S.A. DE C.V., to charge your credit or debit card.
  • Means to limit the use or disclosure of personal data.

To limit the use or disclosure of their personal data, the owner must send an email, addressed to the Information Privacy Office, to the following e-mail address: datospersonales@mutuo.mx, requesting the limitation of the use or disclosure in question, where they can request to be included in the internal exclusion lists not to contact for promotional and logical marketing purposes.

  • Means for exercising the Rights of Access, Rectification, Cancellation or Opposition (“ARCO Rights).

In accordance with the Law, the owner of the personal data has the right to Access (“Access”) to the data held by the Data Controller and to the details of their processing, as well as to Rectify them if they are inaccurate or incomplete (“Rectification”); Cancel them under the terms of the Law (“Cancellation”) or Oppose the processing of the same for specific purposes (“Opposition”).

The owner of the personal data or their legal representative may exercise the rights described above through one of our facilities or by sending an email to the following email address: datospersonales@mutuo.mx, stating that they are requesting to exercise their “ARCO Rights”. This request can be made in a free written form considering the elements of Article 29 of the Act or the Privacy Office will send you in response the format for the exercise of “ARCO Rights”.

For the request to exercise your “ARCO Rights”, you must consider the following requirements:

  • Official identification of the owner.
  • Enter the email to let you know the response to your request.
  • Clear and precise description of the personal data with respect to which one seeks to exercise any of the above-mentioned rights.
  • If the right is exercised by a representative, official identification and the document certifying their representation must be provided.

In the event that the information provided in the request is insufficient or erroneous to respond to it, or if the necessary and indispensable documents for your attention are not accompanied, the Responsible Party may request the information and/or documentation necessary to process it in accordance with article 96 of the regulations. The holder will have 10 business days to meet this requirement. The person responsible will respond to your request within 20 (twenty) business days from the date of receipt of your request, this deadline may be extended only once for an equal period in accordance with Article 32 of the Law. If the request is appropriate, it will be effective within 15 business days.

If you exercise your right of access, the means by which you can obtain the requested information or personal data will be in simple copies or electronic documents (which will be sent to the email address indicated in your request). The Data Controller may deny access to personal data, or to rectify or cancel or grant opposition to the processing of the same, in the cases established in article 34 of the Law. The Data Controller will not be obliged to cancel the owner's personal data, under the assumptions established in article 26 of the Law.

  • Revocation of consent.

The Data Controller may revoke the consent he has given us for the processing of his personal data at any time, as established in Article 8 of the Law. For this purpose, it will be necessary to send an email to the Privacy Office, to the following email address: datospersonales@mutuo.mx where you will be informed of the procedure to follow.

  • Transfer of personal data that is carried out.

The transfers made by the Responsible Party will be in accordance with Article 37 of the Law, and in compliance with Article 68 of the Regulations.

  • Notification of changes or updates to the Privacy Notice.

This Privacy Notice may be modified and/or updated at any time by the Responsible Party, in response to legislative or jurisprudential reforms, internal policies, or new requirements, the updated version being the one published on our website datospersonales@mutuo.mx, the one applicable at all times.

In the event that the Data Controller changes his identity, requires the collection of additional personal financial or financial data, changes the purposes for obtaining his personal data or modifies the conditions of the transfers that may be carried out under the provisions of this Privacy Notice, a new privacy notice will be made available to the data subjects, through the email that the owner has provided to the Data Controller or through the Responsible's website.
